These Terms of Service ("Terms" or this "Agreement") constitute a legally binding agreement between You and Bariki (hereinafter referred to as "We," "Us," or "Our") and govern Your access to and use of the website located at bariki.app (the "Site"). By accessing, browsing, or otherwise using the Site, or by submitting information through it, You ("You," "Your," or the "User") agree to be bound by these Terms. If You do not agree to these Terms, You must not access or use the Site.
For the purposes of these Terms:
1.1. "Content" means all text, graphics, designs, logos, marks, code, and other materials made available on or through the Site.
1.2. "Waitlist" means the mechanism by which Users may register interest in receiving early access to the Bariki application.
1.3. "Child" means an individual who has not completed eighteen (18) years of age.
2.1. The Site is intended for students in Classes 7 to 12, their parents or lawful guardians, educators, and other interested parties.
2.2. If You are a Child, You may access the Site and submit information only with the involvement and verifiable consent of a parent or lawful guardian, who agrees to be bound by these Terms on Your behalf.
2.3. By using the Site, You represent and warrant that the information You provide is accurate and that You have the legal capacity, or the requisite parental or guardian consent, to enter into these Terms.
3.1. The Site is an informational website that describes the Bariki product and enables Users to join the Waitlist. The Bariki application itself is under development and is not made available through the Site.
3.2. All descriptions of features, capabilities, timelines, and roadmaps presented on the Site are indicative only, are subject to change without notice, and do not constitute a commitment, representation, or warranty that any product or feature will be developed, released, or made available.
3.3. We do not guarantee that the Site will be available at all times, uninterrupted, or free of errors, and We may modify, suspend, or discontinue the Site, in whole or in part, at any time without liability.
4.1. Joining the Waitlist registers Your interest only and does not create any entitlement to, or guarantee of, access to the Bariki application.
4.2. By joining the Waitlist, You consent to being contacted by Us in relation to early access and related updates, in accordance with Our Privacy Policy.
4.3. We may, in Our sole discretion, determine whether, when, and to whom early access is offered.

6.2. Subject to Your compliance with these Terms, We grant You a limited, non-exclusive, non-transferable, revocable licence to access and view the Site for Your personal, non-commercial use.
6.3. Except as expressly provided, nothing in these Terms grants You any right, title, or interest in the Site or the Content, and all rights not expressly granted are reserved.
7.1. If You submit any enquiry, suggestion, idea, or feedback to Us (collectively, "Feedback"), You grant Us a perpetual, irrevocable, worldwide, royalty-free licence to use, reproduce, and incorporate such Feedback for any purpose, without obligation or compensation to You.
7.2. You represent that any Feedback You provide is Your own and does not infringe the rights of any third party.
The Site may contain links to, or rely upon, third-party websites and services which are not controlled by Us. We are not responsible for the content, policies, or practices of any third party, and Your use of such third-party websites or services is at Your own risk and subject to their respective terms.
9.1. The Site is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including, without limitation, any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

To the maximum extent permitted by applicable law, in no event shall We be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, opportunity, goodwill, or profits, arising out of or in connection with Your access to or use of, or inability to use, the Site.

You agree to indemnify and hold Us harmless from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with Your breach of these Terms or Your misuse of the Site.
Your use of the Site is also governed by Our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, You acknowledge that You have read and understood the Privacy Policy.

16.1. Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
16.2. Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
16.3. Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between You and Us regarding Your use of the Site and supersede any prior agreements.
