This Privacy Policy ("Policy") governs the manner in which Bariki (hereinafter referred to as "We," "Us," or "Our") collects, uses, maintains, discloses, and protects the Personal Data of individuals ("You," "Your," or the "User") who access or use the website located at bariki.app (the "Site"). By accessing the Site, submitting information through it, or joining the waitlist, You acknowledge that You have read, understood, and consent to the practices described in this Policy. If You do not agree with any part of this Policy, You must refrain from using the Site or submitting Your information.
For the purposes of this Policy, the following definitions shall apply:
1.1. "Personal Data" means any data about an individual who is identifiable by or in relation to such data.
1.2. "Processing" means any operation or set of operations performed on Personal Data, including collection, recording, organisation, storage, use, disclosure, or erasure.
1.3. "Data Principal" means the individual to whom the Personal Data relates and, where such individual is a child, includes the parent or lawful guardian of such child.
1.4. "Data Fiduciary" means the entity which, alone or in conjunction with others, determines the purpose and means of Processing of Personal Data, being Us.
1.5. "DPDP Act" means the Digital Personal Data Protection Act, 2023 of India, together with any rules, regulations, or amendments made thereunder.
1.6. "Child" means an individual who has not completed eighteen (18) years of age.
1.7. Any capitalised terms not defined herein shall have the meaning ascribed to them under the DPDP Act.
2.1. This Policy applies solely to the Site and to information collected through it.
2.2. This Policy does not apply to the Bariki mobile application, which remains under development and shall, upon its release, be governed by a separate privacy notice.
2.3. The Site may contain links to third-party websites or services. We are not responsible for the privacy practices of such third parties, and We encourage You to review their respective privacy policies.
We collect only such Personal Data as is necessary for the purposes set out in this Policy.

3.4. We do not knowingly collect sensitive Personal Data (including, without limitation, financial, health, biometric, or governmental identification data) through the Site, and You are requested not to transmit such data to Us.
We Process Personal Data for the following purposes:
4.1. to administer the waitlist and to contact You regarding early access to Bariki and related updates You have requested;
4.2. to respond to Your enquiries, correspondence, and partnership requests;
4.3. to analyse, in aggregate and non-identifying form, the visibility and usage of the Site in order to improve it;
4.4. to maintain the security, integrity, and proper operation of the Site;
4.5. to comply with applicable legal and regulatory obligations.
We do not sell Your Personal Data, and We do not Process it for behavioural or targeted advertising.
5.1. We Process Your Personal Data on the basis of the consent You provide at the time You voluntarily submit such data, in accordance with the DPDP Act.
5.2. Your consent is specific, informed, and unconditional, and is limited to the purposes enumerated in Section 4.
5.3. You may withdraw Your consent at any time in the manner described in Section 9. The withdrawal of consent shall not affect the lawfulness of Processing carried out prior to such withdrawal. Upon withdrawal, We shall cease Processing Your Personal Data unless otherwise required or permitted by law.
6.1. The Site is intended for students in Classes 7 to 12, and accordingly certain Users may be Children.
6.2. Where a User is a Child, We require that the Site be used, and any Personal Data be submitted, only with the verifiable consent of a parent or lawful guardian.
6.3. In accordance with the DPDP Act, We shall not (a) undertake Processing that is likely to cause any detrimental effect on the well-being of a Child, nor (b) undertake tracking, behavioural monitoring, or targeted advertising directed at Children.
6.4. A parent or lawful guardian may, at any time, request access to, correction of, or erasure of any Personal Data relating to their Child by contacting Us at hello@bariki.app, and We shall give effect to such request within a reasonable period.
7.1. We engage the following categories of service providers ("Data Processors"), who Process Personal Data solely on Our behalf and in accordance with Our instructions:
7.2. We may disclose Personal Data where such disclosure is required by law, court order, or governmental authority, or where necessary to establish, exercise, or defend legal rights, or to protect the safety of any person.
7.3. We do not otherwise sell, rent, or trade Your Personal Data to any third party.
8.1. We shall retain Your Personal Data only for so long as is necessary to fulfil the purposes set out in this Policy, or as required to comply with applicable law.
8.2. Upon the expiry of the applicable retention period, or upon Your valid request for erasure, We shall delete or irreversibly anonymise Your Personal Data.

11.1. We implement reasonable technical and organisational security measures designed to protect Personal Data against unauthorised access, alteration, disclosure, or destruction, including the transmission of the Site over HTTPS and the restriction of access to submissions.
11.2. Notwithstanding the foregoing, no method of transmission over the Internet or method of electronic storage is entirely secure, and We cannot guarantee absolute security.
11.3. In the event of a personal data breach affecting Your Personal Data, We shall take such action, and provide such notifications, as are required under applicable law.
Certain of Our Data Processors may store or Process Personal Data on servers located outside India. Where such transfer occurs, We shall take reasonable steps to ensure that Your Personal Data continues to be afforded protection consistent with this Policy and applicable law.
13.1. We reserve the right to amend, modify, or update this Policy at any time in Our sole discretion.
13.2. Any changes shall become effective upon the posting of the revised Policy on the Site, and the "Last Updated" date shall be revised accordingly. Material changes shall be brought to Your attention by prominent notice on the Site.
13.3. Your continued use of the Site following the posting of any amendment shall constitute Your acknowledgement of the amended Policy.
Bariki is operated as a student-led initiative. For the purposes of the DPDP Act, We act as the Data Fiduciary in respect of Personal Data collected through the Site, and We may be identified and contacted at hello@bariki.app.
